Areas of Practice
spam calls/texts/faxes
“Computerized telephone calls are the scourge of modern civilization. They wake us up in the morning; they interrupt our dinner at night; they force the sick and the elderly out of bed; they hound us until we want to rip the telephone right out of the wall. . .” 137 Cong. Rec. at S16205-S16206 (November 7, 1991).
Nearly 30 years later, Senator Hollings comments still ring true. In today’s era, this is even more troubling with the inescapable nature of cellular telephones, including phones that need to be with you at all times for business purposes. Using local Caller ID numbers, telemarketers will apparently use any means to attempt to ensure that you answer unwanted calls. If you feel you’ve received unsolicited communication in violation of the Telephone Consumer Protection Act, request a free consultation by reporting it here.
Unpaid overtime
The general rule is that if you are an hourly employee who works over 40 hours in a week, you are entitled to receive 1.5 times your normal pay rate under the Fair Labor Standard Act. If your employer has unfairly denied you overtime pay, you might be entitled to recover that amount, plus an additional award and attorneys fees, so that you don’t have to pay for a lawyer out of your own pocket.
If you believe you’ve been unfairly denied overtime compensation, please request a free consultation above.
calls using your dmv info
Often in unsolicited telemarketing calls regarding extended auto warranties, the Drivers Privacy Protection Act will be implicated. The Drivers Privacy Protection Act requires all States to protect the privacy of personal information contained in an individual's motor vehicle record.
The Act imposes criminal fines for non-compliance and grants individuals a private right of action including actual and punitive damages, as well as attorneys fees. If you’ve received an unsolicited call for an auto warranty, please request a free consultation above.
Unfair credit card handling and receipt practices
For nearly 15 years, the federal Fair and Accurate Credit Transaction Act has been attempting to prevent fraud and identity theft. For their part, businesses are required to shorten your credit card number on receipts to no more than the last five digits of the number as well as removing the expiration date.
The Act provides for statutory damages ranging from $100 up to $1000 per each willful violation, including knowing or reckless violations. Consumers can protect themselves from identity theft and privacy violations by carefully reviewing their receipts. If you believe a business has violated this Act, please request a free consultation above.
abusive debt collection
Financial hardships happen. Unfortunately, debt collectors are typically paid by the amount they collect and often do so without regard for their tactics. The Fair Debt Collection Practices Act provides consumers with recourse, including the ability to recovery actual damages plus up to $1,000 and fees for an attorney so all the remaining damages go to you.
There are many ways debt collectors violate this act - if you believe you’re being subjected to unfair collection or debt practices, request a free consultation above.
